Thomas v. Ferguson, 560 S.W.2d 835 (Ky. App. 1978) and Stone v. Montgomery, 618 SW2d 595 (Ky. App. 1981). For example, if the injured party has a claim for $20,000.00 in medicals, they will only receive $10,000.00. This is an important reason why you should purchase Kentucky no-fault on your automobile, truck or motorcycle.
FAILURE TO PURCHASE NO FAULT INSURANCE DOES NOT REDUCE THE CLAIM OF MOTORCYCLIST OR PERSON REJECTING NO-FAULT.
The above law excluding the first $10,000.00 of a motor vehicle accident victims claim for medical expenses and lost wages does not apply to motorcyclists or any one who has rejected Kentucky no-fault because they are no required to carry no-fault coverage on their vehicles.
